Surrogacy in India – As per ART Act & Surrogacy (Regulation) Act

Eligibility for Intended Parents

  • Couples Only: Only married heterosexual couples are eligible.
  • Marriage Duration: Must be married for at least 5 years.
  • Age Limit:
    • Women: 23–50 years
    • Men: 26–55 years
  • Medical Requirement: The couple must demonstrate medical infertility, verified by a certified fertility specialist.

Eligibility for Surrogate Mothers

  • Age: 25–35 years
  • Must have at least one child of her own
  • Healthy, physically and mentally fit
  • Cannot have undergone more than five live births or multiple pregnancies
  • Must provide informed consent

Ethical Protection: Surrogates cannot be coerced; compensation is regulated and fully transparent.

Legal Framework for Surrogacy

  • Contracts Required:
    • Between surrogate, intended parents, and clinic
    • Covers medical care, compensation, parental rights, and confidentiality
  • Parentage: Intended parents are legally recognized as the child’s parents from birth
  • Surrogate Compensation: Only altruistic surrogacy is allowed for Indian residents (payment for pregnancy is permitted only as medical and insurance coverage; commercial surrogacy is banned).

Process Under ART & Surrogacy Regulations

  1. Medical Evaluation: Assess infertility and suitability of intended parents.
  2. Legal Documentation:
  • Surrogacy agreement
  • Clearance from the state ART/Surrogacy Board
  • Gamete Collection: Eggs and sperm are collected from intended parents or donors.
  • IVF / Fertilization: Embryos created in a licensed ART clinic.
  • Embryo Transfer: Embryos transferred to the surrogate mother’s uterus.
  • Pregnancy Monitoring: Surrogate receives prenatal care; intended parents receive updates.
  • Delivery & Handover: Birth occurs in a hospital; legal parentage is transferred to intended parents.

Note: All ART procedures must occur only in a registered clinic licensed by the ART Authority of India.
